Terms and Conditions
PRICES
This is strictly a wholesale list and intended for those engaged in buying and selling nursery products. Prices are based on current market conditions and subject to change without notice. All quotation are F.O.B. McMinnville, Tennessee.
ORDERS
We
accept all orders subject to prior sale of stock and crop conditions.
Orders shall be void should injury be caused beyond our control,
such as flood, drought, fire, frost, hail, errors in count, etc.
TERMS
1%
discount 10 days, net 30 days for those who have established their
credit with us. Satisfactory references are required from unknown
parties. Past due accounts are subject to a service charge of 1.5%
per month (18% annually) interest. Service charges effective 30
days from invoice date.
WARRANTIES
We
exercise the greatest care to keep our varieties pure and true to
name and hold ourselves in readiness at all times either to replace
on proper proof all stock that may prove otherwise or refund the
original purchase price. Purchaser agrees that under no circumstances
shall we be liable at any time for any amount greater than the original
price. Any unsatisfactory stock must be reported immediately and
held for advice from us as to disposition.
CONDITIONS OF
SALE
The parties hereto agree that any dispute arising
out of the sale of these goods shall be arbitrated exclusively in
the chancery court for Warren County, Tennessee and the state of
Tennessee shall be the forum for any and all litigation that may
arise from any sale of goods by the seller. Either party not prevailing
in such action shall be liable to the prevailing party for reasonable
attorney fees.
DELIVERY
We
have access to local trailers for delivery. All shipments travel
at the risk and expense or purchaser.
LARGE QUANTITY ORDERS
We
do offer special quotations on large quantities. Please feel free
